A comic book store’s trademark infringement claims against a competitor over the “Cloud 9 Comics” mark beat out an attempt to throw out the suit, according to an Oregan federal court order.
Cloud 9 Comics LLC, an Oregon store, accused the Missouri-based Cloud 9 Comics and More LLC of trademark infringement and unfair trade practices for its use of the “Cloud 9 Comics” mark. The Oregon store sufficiently alleged its ownership of the mark for the claim to move forward, Judge Michael H. Simon for the U.S. District Court for the District of Oregon wrote in an order.
