Every claim is different, and some insurance policies can be difficult to interpret for unique situations. FC&S Expert Coverage Interpretation, the recognized authority on insurance coverage interpretation and analysis for the P&C industry, makes it simple to find credible answers to your complicated coverage questions. Analysis brought to you by our FC&S experts.

Editor’s Note: Can an insured choose to file a claim under the policy with the lowest deductible regardless of where the loss occurred? We deal with that issue in this week’s Coverage Q&A.

Question: Our insured’s company vehicle was stolen from a parking ramp while he was out for the evening. The vehicle was covered by another insurance carrier, as was his business personal property policy. He also had some personal property in the vehicle that he wants to claim.

Our policy with the insured is for a secondary/seasonal home. He has not turned a claim into his carrier for his primary residence because he has a higher deductible ($2,500 vs. $1,000). It is a higher-valued home, and he doesn’t want his premium to go up on that policy. We only write the secondary/seasonal property and believe he needs to go to his primary carrier first, but where would we pull the policy language?

Analysis: Many insureds have more than one dwelling. Often, a primary home and then a second home at the beach or mountains where they vacation. Coverages on the properties are, of course, specific to the property, and the deductibles may be different as well, depending on what the insured decided he wanted to cover for himself when he set up the policy. In the event of a loss, which policy can a claim be filed under?
